On 12 November 2025, the Delhi High Court looked straight at this confusion and basically said: you can’t run a country on vibes and personal morality alone. The court was hearing a case where Customs had seized two consignments described as “Head and Chic Massager” and “Silicone Therapy Sleeve”. These were imported under a category meant for mechano-therapy appliances and massage apparatus.

Customs decided they were “sex toys”, called them obscene under a decades-old 1964 notification, and blocked the imports. The importer argued: these are legitimate body massagers sold worldwide, and the same or similar products have been cleared for other companies in India before.

That’s where the High Court stepped in and said something very simple but very powerful: you can’t let one officer’s personal idea of morality decide what the whole country can or cannot import. If there is going to be a restriction, it must be based on clear, national standards, not mood swings and imagination.

The court also noted that similar products have been cleared at other ports, which makes the seizures look arbitrary and inconsistent. That’s why the judges directed the Central Board of Indirect Taxes and Customs (CBIC) to hold inter-ministerial consultations and come up with a uniform national policy on how “sex toys” should be classified under import laws.

In simple terms:
“Stop guessing. Make clear rules. And apply them fairly.”

When ‘obscene’ is just someone else’s discomfort

The Delhi High Court didn’t speak in isolation. It leaned on a 2024 Bombay High Court ruling that had already criticised Customs officials for using “subjective opinions” to decide what is obscene. Both courts said you can’t stretch the law based on your imagination of how a product might be used.

The Delhi HC emphasised that a 1964 notification banning import of obscene “books, drawings, figures or articles” should be read in context: things similar to pornographic material, not everything that makes someone blush. A massage device, designed for therapeutic or personal care, doesn’t automatically become porn just because someone somewhere might use it sexually.

The court also reminded everyone of a 2014 Supreme Court judgment on “community standards”. Obscenity is not frozen in 1964. It has to evolve with time, with what society today finds acceptable, normal, and part of everyday life.
